    Question CSC in the First Degree Case

    My question involves criminal law for the state of:

    I currently reside in Michigan. I was sexually abused between the ages of 10 and 17 in California and Illinois. My abuser now lives in Nevada. Only when I was 18 was CPS notified and "investigated" a case for my sister. No legal options were ever presented to me. It has been 5 or 6 years since I was last used sexually by this person.

    My questions are: what would be the statute of limitation in this case? what state would I have to go through to pursue legal action? if I have no hard evidence of this, would it even result in anything?

    I know that a felony of Criminal Sexual Conduct in the First Degree is what happened to me, and I am thinking more about pursuing justice, if possible. Thank you for any help you can give me.

    Prosecution would occur where the acts occurred. You can report whatever occurred to the legal authorities in those jurisdictions and they will decide if there is a potentially viable case. The case would appear to be viable in Illinois and would likely be viable in California depending upon the full facts and when the offender left the state.

    Are you stating that you and your sister reported the abuse back in 2004, and that the decision was made at that time only to pursue the accusations made by your sister and not those made by you? Was this person charged? Convicted?

    I was 18 and a social worker from the hospital that I had been admitted to notified CPS of what I said. The social worker said she had to report because my sister was a minor living in the same house. My sister never said anything happened to her. After CPS "investigated" by asking my sister and then asking the offender, and then both saying "no." I was told that they wouldn't be able to help me. Through the circumstances, I was left alone and my focus was turned to surviving as a homeless 18year old, still in high school. The option to press charges was never offered to me. I didn't know my rights until now as I'm researching.

    He left the state of Illinois in 2008 (I left in 2005), we both left the state of California in 1999. I know he's guilty of CSC in the 1st degree in both states, if penetration is defined with his fingers and tongue as well. I don't necessiarly have physical evidence though and no one else knew. I have therapists that could talk on my behalf but that's about it.

    I just want justice for all the pain he's caused in my life.
