    Default Is Emancipation the Corect Legal Procedure

    My question involves emancipation laws for the State of: Louisiana

    i'm 17 years old and i have been considering emancipation for three years now. however, i'm worried that the court system will say that i have no grounds for emancipation. my mother has mental issues that she refuses to deal with, letting them pile on me instead. it is affecting my school and social life. i also do not have a job but i know i am mature enough to hold one down. i'm in honors an AP courses at school, which should warrant that i am mature enough to take care of my self. i'm also not sure if emancipation is the correct legal procedure; my mother collects social security for me every month because my father passed away when i was 7. i have looked into the basics of emancipation and it says that your guardians are completely free from financially supporting you. does this mean i will be unable to collect the social security instead? my father also left money in an account that will help to pay for college and tuition. will i be able to access this as well? is it possible to go about this a different way in which i am able to receive this money necessary for things like housing, food, and tuition? i am only a junior in high school so obviously i am unable to support a full-time job.

    Emancipation is not a tool for minors who want to leave home for whatever reason. It is to allow those already independent to act as adults in certain situations that would be denied to them. If your parents are abusive, the option is removal to a foster home, not emancipation.

    If you are unable to completely support yourself, then "they" would be right; you are not a candidate for emancipation.

    If you were thinking that the social security benefits would then be sent to you and you could use them to support yourself, you would be mistaken. If you were emancipated, you would be considered a legal adult; if you were a legal adult, you would not qualify to receive these benefits (which will stop when you are 18 in any case).

    Louisiana has funky emancipation laws. But if you run away from home despite your mom's remaining willing to provide you with a home, don't expect to be getting a Social Security check that would otherwise go to her for your support.
