    Default Breach of Contract for Non Compete with Late Paychecks

    My question involves independent contractors in the state of: Arizona

    if you have a non compete agreement and you are an independant contractor and the company you work for is not paying you on time are they in breach of contract

    They may be in breach of your IC contract. That does not void the rest of the contract or an NCA.

    However, a noncompete and independent contractor status are incongruent. One of the major indicators of a valid IC is that you are able to ply your trade to multiple customers of your choice. An NCA prohibits that option.

    Are you sure you meet the criteria for IC status? You may be misclassified.
