    Default How Do I Set Aside an 8 Year Old Default Judgment on a Divorce

    My question involves a marriage in the state of:California

    This divorce has been in default for 8 years and I have been trying to do something about it for two years now. Judge did not allow it the first time around he said because I took so long to do something about it. They are now giving me another chance with a different judge. What is a good reason to give him so that he sets it aside. My ex-wife rather it stay in default and is doing everything in her power to leave it that way while she tries to use it to gain legal resedency. Can I really stay married to her forever because of this default. She won't give me the divorce. I feel I have one last chance. HELP please??

    Generally speaking, if you've known about the default judgment for most or all of the time at issue, there are no good reasons to set aside a default judgment after eight years.

    Do you care to share any facts that might explain your delay in acting?

    Your various posts seem contradictory - you really need to stop breaking the forum rule against double-posting. Looking at some of your other threads it appears that you mean your case was dismissed somewhere between five and eight years ago due to your blowing off a court date, not that a default judgment was entered. That's a completely different question. But again, you would have to share facts explaining why you chose not to go to court as required, and why you chose not to try to reinstate your case in a timely manner.
