My question involves criminal law for the state of: Utah
I was arrested 6 days ago for DV Assault. I was also forced to sign a paper that was a "no contact order" even though I was intoxicated and said no to the officers question of "do you understand". While waiting to be booked, I called my fiancee unaware of the No Contact Order. I was then informed that I recieved an additional charge for violating that order and had no bail until I saw a judge the following day. I never saw a judge and late that night I received paperwork on my original charge with a bail amount of 2500. After 5 days (3 actually since weekends arent included) my fiancee tried to figure everything out. the only agency who knew of the new charge was the Jail. DA's office, the court system, city prosecutor, no one had any knowledge of the no bail or new charge. After 2 days of phone calls to everyone, he was able to move my court date up 1 and 1/2 weeks (had he not I would have been in jail for 2 weeks and 1 day before even seeing a judge.) The same night he arrainged this, I was suddenly released from jail, no bail, nothing.
I spent a total of 6 days in jail, first time ever in 35 years being arrested, and never saw a judge, or posted any bail. HOW?? Who has the authority to release a person from jail other then a judge? And why would they suddenly release me after it was addament that I could not be released until I saw the judge?? What "nerve", or mistake could have possibly be made for my release to happen at the turn of a hat?
