My question involves police conduct in the State of: California
My eldest stepson (minor, 17 years old) was arrested for public intoxication. They called for us to pick him up from the station. We wanted for him to stay there and scare him straight (his biological mother agreed). We wanted him to be moved to the juvenile detention, since our city jail is more like a hotel, they don't even hold him in a cell. We were going to place him into a rehab the next morning.
Since the police officers continued to call many different family members (allow my son to call) for someone to pick him up. The Biological mom finally called the station and the police officer told her that he is not going to do her job if he is out of control. He spoke with his sergeant and he approved to file child endangerment charge on her and my husband (biological father). Can they do that? My son has been physically abusive to his mom and he refuses to speak with my husband or see him since an argument he had with him.
