    Default Name Change with No Paternity Established

    My question involves name change laws in the State of: FL
    My son has no father listed on his birth certificate. There is no legal paternity established. His father is now in jail AGAIN for more charges, this time drug related. How difficult would it be to change his name while there is no paternity established? I really don't want him carrying this weight with him if at all possible. Dad has no contact, has not since child was 3 months old due to a protection order. Is this a case where the courts would probably just agree to hyphenation? Or do I have more of a chance since there is no paternity?

    You understand that changing the child's name will not erase the child's father from his life, correct?

    There are FL family law forms right here.

    Yes I understand that. I just would like my son to have to same name as myself, since his father is very unlikely to be a very active role in his life. Thank you for your help.

    You can always change your name to match your son's - that way you don't need anyone's permission at all.

    I understand the concept, but I don't want to have the negative connotations that his name would carry after all his criminal offenses. Especially if I never married the guy.

    The only "negative connotations" that are attached to the name are those in your head. It's just a name and I am sure that MANY people have the same last name as your son. I highly doubt that everyone with the last name of Mason, Bush, Dalmer and Bundy went running to the court to change their name due to "associations".
