    Default Emancipation After the Age of 18

    My question involves emancipation laws for the State of Texas.

    I have a stepson who will be 20 in Jan of 2011 . He has skipped two semesters (between high school graduation and starting college) and is now planning on going to college in the spring semester - Jan of 2011. He is still living with his mother (we are divorced two years now, he was 3 when we married), but is working full time. How long can he claim to not be emancipated?

    It really depends upon the purpose - legally, he is already emancipated. But for financial reasons (FAFSA, child support etc.,) he might not be emancipated.

    More specifically, that is the question. I have custody of the elementary age daughter that I share with the mother. Her child support was reduced because even though he was 18, he had not yet graduated high school. I'm wondering, specifically, when he is considered emancipated. He may live with her forever. The only reason he has looked into college is because he has the opportunity to take a new job that will pay for his schooling, provided that he pass. It remains to be seen if he actually enrolls in college.
