    Default Returning Resident Application

    Hi,

    I acquired my permanent resident card (which expires 2017) and flew to the US in March 2007 but stayed there only until May 2007. I have a preexisting condition (Traumatic Brain Injury) which paralyzed the entire left side of my body due to a vehicular accident in September of 2005 and was not able to get a medical insurance because of it. I went back to the Philippines to seek treatment and had not been able to go back since because of several other reasons. My father who supports me financially cut communication lines due to a personal issue that we had so i was forced to work and finish my studies here. Also, my mother encountered a financial crisis so I worked to be able to support her as much as I could also. I am still working and was not able to finish my studies thinking that I would just take an online degree if and when i get back to the US. Now, my father and I are once again talking and I would like to apply for a returning resident status to go back, start a new life once and for all and of course get more advanced treatment for my condition. What are my chances? I mean, do i have a good chance of being allowed to go back under these circumstances that I mentioned and what, how do i fix my status? Please advice. Many thanks!

    You may apply for a Returning Resident (SB-1) immigrant visa.

    From what you've told us so far, I expect that ultimately you will have to restart the process of applying for permanent residency.

    Thank you Mr. Knowitall, i would indeed apply for a returning resident immigrant visa for i have supporting documents both medical and financial to support my claim and true enough, the reasons were beyond my control. May i know why you're saying that you ultimately expect me to restart the whole process? Because frankly, I am in a race against time for our brain cells regenerate fastest until were 26 and i also wish to acquire a therapeutic hand device that can be found in the US and at present, i am aware that persons with preexisting conditions can now be granted medical insurance under the current government. Others, please advise. I would like to hear from a lot of people before i prepare everything please. Thanks a lot!
