I have been in US for last 6 years and was arrested for a ClASS A misdemeanor for selling alcohol to minor in 2005. After this nothing really happened and one day I received a letter from Police Dept that DA has rejected the case and they are returning my bond money. I never made any effort to pursue it further.
For my first H1B stamping I went to India after consultation with a lawyer and he gave me a packet of documents addressed to Consulate General explaining what happened and why this arrest does not render me inadmissible to US. Even though I disclosed my arrest the VO was least interested in it and I got my visa right away. This was Jan 2008.
For my second stamping again I went to same consulate and got a 221g. I have not changed my employers ever since and I nothing has changes since then except that now I have my I-140 also approved. During the interview VO did not ask much just asked have I been arrested since Jully 2005 because I had explained in DS 160 about the arrest. To this question I answered no as that was my only arrest.
VO did not ask me for any docs etc and said visa approved but will take 2-3 weeks. I have been now waiting for 7 weeks and no communication from consulate. My passport also is held up at the consulate. Not sure what is the cause of this check but i'm getting worried now...any tips suggestions are greatly appreciated.
