My question involves criminal law for the state of: Texas
Hi, my son called me this morning around 6:00AM saying he was in the hospital. He said that early this morning he went outside of his home to smoke a cigarette and he overheard some people yelling at each other outside on his street so he walked further out into his yard to see what the commotion was. To his surprise it turned out to be my sons ex-girlfriend and her new boyfriend sitting outside in front of his home arguing.My son overheard the new boyfriend yelling at his ex saying "do you still love him!?". He jumped out of the car and told my son to stop texting his girlfriend. My son and his ex girlfriend have a daughter together and my son tried to explain that any text that were sent were simply about his daughter and that he had no intention of fighting. Well at that point the unknown male attacked my son and beat him badly enough to put him in the hospital. My son has already filed a police report and gave them the license plate number of the vehicle they were in and who assaulted him. Now his ex girlfriend is claiming they were NEVER there and that there are no witnesses to back up his claim. The ex girlfriend's mother is also saying that her daughter was at home all night which is an absolute LIE! Is there any legal action that can be pursued against my sons ex girlfriend or her current boyfriend? They are denying ever being there and my son's only proof is that he is in the hospital. PLEASE HELP!! What should he do in this situation??
