    Default Tenant Claims to Own Leased Building

    My question involves real estate located in the State of: Louisiana. My dad bought a piece of property with an old building on it. My girlfriend (18yrs) and I invested to remodeled the building with a permit to repair water and termite damage, plumbing, elect..I went way over the cost estimate with the inspector turning his head.( La. politics)After the work was done my dad gave my girlfriend a five year lease on property and building. We are now trying to evict my ex girlfriend because she will not put my dad on the fire and windstorm insurance policy. She claims to have built the building. Her lawyer seems confident and our eviction lawyer says we need to worry about the ownership of the building.I need to know what kind of claim she might have so I can research the matter. Thanks

    If a lease is signed, and she is paying in accordance to it's terms, and not violating any provisions, then she cannot be evicted.

    If the lease was done properly, it would not only require the tenant to carry insurance but also to require inclusion of the landlord as the "additional insured" on it. If the lease does not say that however, she is not legally bound to do so, and thus not in any violation, and no grounds for eviction

    You dad can always get an insurance policy on his own as landlord.
