    Default Unethical Realtor and Inspector

    My question involves real estate located in the State of: Nevada, Clark County

    Hi, all. I purchased my very first home with an FHA loan in October of 2008. Ever since, I have been finding small things wrong with my house, some of which are blatantly lied about on the inspection. My realtor called in "her guy" to inspect my condo and I am now thinking, two years later, that the two of them took me for a ride. The inspector lied about seismic straps on the water heater, the condition of the fire place, the venting for the dryer, and the wiring throughout the house. All of this is documented in the inspection review. I have several fans that he listed as "inoperable" when in fact they actually have no wiring going to them-- they are literally just stuck in the ceiling. My a/c broke exactly one year after my purchase of the home. Several outlets throughout the house do not work at all, which is not listed on the inspection. My realtor was very pushy and misleading near the end, telling me to bid higher than I should have. Being a first time buyer, I did exactly as she said. I also believe that she pulled outdated comps (comparisons) for recently sold properties and prices. What, if anything, can I do about this? The home inspection part is the worst, as some of the issues I have discovered in the time since purchasing are dangerous.

    First of all, is this agent with a brokerage representing the "seller"?? Or is this agent a "buying" agent that you hired and signed a contract with??

    If this agent represents the seller, i.e the listing agent", or another agency selling the house through the selling agent, the obligation is to the SELLER and not the buyer, i.e. YOU, and this includes "please bid higher", as the primary obligation of the seller agent is to get the best price. If the seller ever hears an agent representing him tells a buyer "don't bid so high", he can sue his agent for violating his or her fudiciary responsibility for getting the best price because you don't say "don't bid so high" in order to get the best price.

    The seller agent depends on the representation of the seller, and then the inspector, as the agent is not responible for knowing if blowers are wired up, or if wires in the walls are done correctly. In fact, as a real estate investor, I've had enough houses inspected, and I never seen an inspector ripping out blowers to see if wires are hooked up to them.

    You can consult with an attorney to see if you have grounds to sue the seller for fraud, or the inspector for negligience, but the problem is that this is two years later.
