    Default Neighbor Refuses to Seal Property, Putting My Building in Danger

    My question involves real estate located in the State of: New York

    I have an unusual situation.

    I live in a brownstone in New York City. The building next to mine has been unoccupied since 1995 and is partially sealed, but squatters / homeless are entering the building through the rear fire escape and the roof of the building. The police refuse to enter the building to remove the squatters. The owner will not seal the building properly.

    I am worried, with the winter approaching, that squatters will start a fire, which may endanger my building. This happened to a nearby building last year.

    Legally, is there anything that I can do?

    It is difficult to sue on the basis of what may happen.

    I would wait for the first sign of fire and call the fire department... over and over. Call the police every day if you have to.

    Have you thought about sealing the building yourself? Plywood and a lock is reasonably cheap insurance.

    Sealing the building ourselves would, unfortunately, make us liable for any unauthorized construction on that property. Since the building is sealed in the front, we'd have to go through another brownstone to reach the yard.

    The frustrating thing is, this is a disaster waiting to happen and no one is willing to take responsibility for it, including the city or the owner.

    What is the reason for the city's reluctance to remove the squatters?

    Have you contacted the health department?

    No, I don't think that our condo contacted them. Good idea!
