    Default question about petty thief misdemeanor

    If you get a petty thief misdemeanor expunged in California then can you still go into education or research such as a teacher in high school or a professor in college?

    Also is it true if you stay out of trouble for 7 years after your conviction that the background check in CA will not show your past conviction?

    I was also wondering if anyone had any stories about their experience for job hunting after they got their conviction expunged. For example, were employers willing to listen to your story about the conviction and if people were still able to get jobs in the professional fields?

    When you get something expunged it means that you records are destroyed. Future employers will not have access to the information, and you can legally say that you have not been convicted of anything, and you will not need to disclose any information about the incident. x

    Expungement laws vary from state to state. Most states do have a provision that once your record has been expunged, you may lawfully state on an employment application, etc., that you have never been convicted of an offense (provided that it was the offense that was expunged). In most states, when an expungement occurs that does not mean that records are physically destroyed--what generally happens is that a court enters an order sealing and sequestering the records so that the general public will no longer have access to them.

    Once an expungement occurs, it is generally true that most employers are not going to have access to this information. It will normally remain on law enforcement databases such as NCIC and will normally be available to law enforcement authorities. Only certain people can access such databases. There are some occupations which are sensitive--here again it varies by state--so for some occupations the employer may be able to have law enforcement do the check and an expunged offense will show up. The legislature of each state, generally speaking, makes these determinations.

    Bottom line, if you are interested, you will need to contact an attorney in your particular jurisdiction to address your particular situation, but generally these are the principles relating to expungement.
