    Default A 17 Year Old Wanting to Be on Her Own

    My friend lives in Washington state. She hates living there, hates living with her uncle that verbally abuses her, and wants to move to Oklahoma with me. She wants to just get her GED and go to college. But shes 17 years old and doesn't turn 18 till June of 2011. I'm financially capable of taking care of her and she will get a part time job. Is this legally possible? And if so, how? I mean I'm will to go as far as to get married to her to get her at Age of Majority.

    She can't get married in Washington until she is 18 without the consent of her legal guardian. Until she is a legal adult at 18, she lives wherever her guardian tells or allows her to live. If uncle says she lives with him until 18, then that's where she lives. Interferring with the legal authority of a parent or guardian could not only mean a restraining order against you (even if she objects), but can also result in criminal charges against you for things like interferring with custody, harboring a runaway, or contributing to the delinquency of a minor. If you transport her across state lines, you could very well be facing federal criminal charges. Bottom line is that her uncle holds all the legal cards until she is 18. If there is physical abuse or neglect, she can contact child protective services; understanding that if they FIND evidence of such, that THEY will determine where she will live, and it will be either with another family member, foster care, or a state home. Under no circumstance will CPS place her under your care.

    The answers (and in fact, most of the responders) are going to be exactly the same on this board as the one where you previously posted. The law does not change because you ask again somewhere else.

    I'm not going to take her out of state if its illegal. Jesus Christ your making me out to be some freakin Pedo-Bear. Im not interested in her like that.

    Yes. It is illegal for you to take her out of state. It is illegal for her to leave home without permission as long as she is even one minute younger than 18. Is that clear enough for you?

    The answers you got WERE definite. I don't know how we could have made it any clearer.

    The definite answer is that she is not a candidate for emancipation, and if you take her across state lines without the permission of her legal guardians, you can be prosecuted under Federal human trafficking statutes and go to prison for a long time.

    Read what Catherine explained very, very carefully. Internalize it. Then put this idea of "saving" your girlfriend right out of your head. Unless NutraLoaf is your thing, I guess.

    Jesus is not concerned with violation of law until final judgment. :-)


    The others were correct. They did not IMO, assert any type of sexual crime accusation, per se. The point was removing her from state to state is crossing state lines and becomes federal jurisdiction for kidnapping.

    Do not send her funds to do so either, as you need not physically transport to be charged with a crime.

    The situation is unfortunate, but the LEGAL comments were on mark.

    She needs to try to work it out somehow, tell her to seek out a counsel of some sort etc.
