    Default Question about misdemeanor and criminal record

    When applications ask for felonies then do do you have to answer 'yes' if you have a misdemeanor?

    Can you vote in California if you have a misdemeanor on your record and are still on probation?

    If you have a shoplifting misdemeanor then can you teach at a high school or college?

    How detailed are criminal records for past convictions? For example on petty thief will it show what you stole and where?

    If you are asked only about felonies, you don't have to describe misdemeanors. Misdemeanors are lesser offenses than felonies, and do not fall within the category of "felonies". A misdemeanor conviction should not affect your civil rights, unless (as is obviously not the case here) it is one which triggers a reporting requirement as a sex offender.

    Any honesty offense can potentially affect future employment. A shoplifting conviction, though, shouldn't be a bar to employment.

    A criminal record will not contain details about what was stolen or, beyond refelcting the court where the conviction occurred, where the offense occurred.

    Yes you can vote. Check out California voter's registration:

    ESR generally recommends the following language for California employers based upon language recommended in Human Resources publications. The language is as follows:

    Have you ever been convicted for a crime? (Exclude convictions for marijuana-related offenses for personnel use more than two years old; convictions that have been sealed, expunged or legally eradicated, and misdemeanor convictions for which probation was completed and the case was dismissed)

    No.

    Yes.

    Legally, yes. But a school or college could establish higher standards than the state minimum standard.

    How detailed are criminal records for past convictions? For example on petty thief will it show what you stole and where?
    It depends on the record. If they search court records (public documents), they COULD find pretty good detail. In CA since employers cannot search state criminal offender records (though certain positions such as teaching do require a fingerprint check of your record through CA DOJ and the FBI). Any record they receive based upon this fingerprint return would be very basic - the charge, the date of the charge, the originating agency, and the disposition.
