    Default H1-B Visa Filing

    Hello,

    Well my company is filing H1-B for me and it has never filed an H1-B visa before. The company is in good standing. Everything is good.

    But the problem is that they mentioned in the Job Description that "Bachelors in Information Technology " is required and also asked for minimum "5 years of work experience in IT" is required. And my profile is like 4 years of experience in IT and have my bachelors in Accounting and MBA in Finance. My work experience was after my bachelors. I just got a job after my MBA.

    Now I asked them if they could change the Number of years of work experience required and the degree requirement from the Job Description. They said that they CAN'T do it.

    And now I am realy tensed about the situation that what would happen once I file H1-B visa. Most probably my attorney will be filing it this week. Will it create any false impression on USCIS people or does it hinders my chances to get the visa?

    Please advice. People who have faced this kind of issue also reply please.
    Waiting desperately for experts reply.

    Are you stating that the company wants you to lie about your credentials, or that you fear that your application will be rejected when you accurately disclose your credentials?

    Well no I am not lying and neither my company has asked me to do that. Its just that the Degree requirement in the job description differs from my degree and I don't have the required number of work experience.

    I amfiling the visa with all actual credentials but I just wanted to know my chances of getting H1-B visa since the degree differs and I also fall short for the number of years of workex.

    THoigh degree differs but I have the 4 years of workex that they demanded. Will there be any inquiry from the govt. about my degree or workex??

    Please advise.

    If you don't have the credentials necessary to satisfy the requirements set forth in the labor certification, I'm not optimistic that your visa will be approved.

    So according to you the degree difference will create problems in my candidacy? Is there anyway to correct it. I mean if my employer sends a letter to DOL stating that they really need me inspite of the degree difference, would that have a positive impact?

    Based on my experience the USCIS may ask for more evidence from either you or your employer why you qualify for this position even with different degree and less work experience than it's required.
