    Default Can I Seek Remainder of Broken Lease Rent in Court

    My question involves an eviction in the state of: Michigan

    My tenant broke an 18 month lease, only paying for 8 months. If I go to small claims am I able to seek the 10 months rent she ended up not paying b/c of the broken contract?

    You have a duty to mitigate your damages by seeking a replacement tenant. You can sue for the rent you lost during the period you were making a reasonable effort to find a replacement tenant, and for the difference in rent if you're unable to find a replacement tenant who will pay rent at the same (or higher) rate.

    Knowitall is right. Find a replacement as soon as possible and sue for the rent from the last day they paid until the first day the new tenant is in place.
