    Default Mother Wants Back Support Five Years After Change of Custody

    My question involves child support in the State of: Washington

    My child was living with someone other than my X for 5 years. The X had legal custody accorting to the divorce decree. The amount of Child support is in Divorce decree. I payed my X child support but less than the full amount that the X agreed too. Now the X wants the full balance of all the money. Since the X did not have custody for 5 years what should I do. The X filed papers with the State asking me to pay $$. Are divorce paper a court order?

    Yes the divorce papers are a court order and if you were ordered to pay her X amount of dollars, then you owe her X amount of dollars. I assume she will pursue criminal contempt for nonpayment if the amount if enough.

    The fact that your child lived somewhere else for 5 years makes no difference since you didn't care for 5 years that she was there.

    Its not that i didn't care that my child was in his grandmother's care. The child did not want to move to a different school district. So If I can get the grandmother to file for child support would that make the money go to her? I want to pay any money owed but would like it to go to the child for college.
    Do I have any options to pursue?
    Should I hire a lawyer?

    First you must get the grandmother to file for custody, if granted, then have her file for child support. The money will go to her, but you will still have to owe the mother the arrears.

    No, you can not choose how the arrears is spent or saved.

    Is there anything I can do?
    Isn't there some law that only lets someone go back so much time?

    You allowed it. It wasn't a problem. Is there anything in the court order that said that the child MUST live with either parent? If so, YOU "broke" the court order as well.

    You're not going to keep the child from mom. If grandmom pushes the custody issue, mom only need to go get her child.
