Default Step Broke and I Fell

Well I was walking down my apartment steps and the step broke(some of the steps were rotted) and I fell down them. I ended up breaking my fifth metatarsal which required me to get surgery and a screw placed in it and for me to be on crutches for 2 1/2 months. I told my landlord and he didn't offer to give up insurance or even help pay the medical bills, although he was quick to repair the steps. So I ended up covering what my insurance didn't and my insurance has been giving me issues about paying for it. Since I'm graduating from grad school soon I was going to join the Air Force but they denied me because of the screw. Should my landlord be responsible for it? This happened in NY about 4months ago.
