    Default Being Sued by Law Firm for Already Paid Debt

    My question involves judgment recovery in the State of:Ohio I am being sued by a law firm for about 6,000 for an unpaid credit card debt. For the past eight years I have made a collection agency payments totally over 9,000. I called the collection agency and told them enough was enough and refused to pay any more. They stated I still owed original balance and is sueing me for it,plus interest. I have proof of all payments. Can theydo this and what do I need to do to defend myself. Thank you

    I have proof of all payments.
    Do you also have proof of the total amount you were to pay?

    You really need to get yourself in to see an attorney. You can get a referral from the Ohio Bar Association.

    They claim I owe original charge off amout of 6,000 back in 2003 when it was wrote off. I started making payments of 100.00 a month till April of this year. I called and asked how much more we owed and told me it was 6,000. I said enough was enough and refused to pay any more. They wanted me to make offer to finish account and I said how about the 9,000 I had already paid them.

    With the high interest rates and penalties associated with late payments on credit cards, it's possible to pay $100/month on a $6,000 balance and still have the amount you owe grow each month. Do you have anything in writing in relation to your agreement with the original collection agency?

    No, All we got was a letter each month saying 100.00 was being drawed out of account. It never said payoff amount or anything else.
