    Question DV Visa: when Applying with Spouse - Does the Spouse Also Get a Green Card

    I would like to apply for the DV Visa with my husband to come live in the US.

    As I understand it we can both apply and have to fill out the information of the respective spouse. If one of us "gets" the green card, what does the spouse receive? Also a green card? Nothing?

    If we weren't married (hypothetically) and marry later after applying for the green card as individuals - what is the difference?

    I didn't say anything about lying, it was an hypothetical question out of interest.

    I did my research on the USCIS website and found out that the spouse is eligible for a derivative visa via form I-485. Let me rephrase my original question then:

    If one of us receives the green card through DV and the other one is eligible for derivative visa - do both applications go simultaneously or does the one getting the green card need to complete the application process first?

    Thank you for the link aaron, However my question is not answered. From the link you provided:
    If only one spouse is selected, the other may enter the country on the Diversity Visa of the winning spouse.

    This is good news, but I still don't know whether the spouse get's some kind of visa. I'm interested in how long the spouse is allowed to stay and whether the spouse is allowed to work.
