    Default Caught Shoplifting, 20 Years Old, First Offense

    My question involves criminal law for the state of: New York (specifically, Long Island)

    So, obviously I made the stupid choice from attempting to steal stuff from a Target. I was of course, was caught and brought into the back room for questioning. I had nothing to hide, I confessed to stealing and was given the price on how much all of what I was attempting to steal was (It was under 100 dollars). They then took down my Name, Phone number and address, and told me that the police would not be notified, that I was banned from that specific Target store (but not any others) and that they would be sending me the civil demand in the mail, which I do intend on paying off no questions asked. Needless to say, this is never going to happen again.

    My questions are: What kind of crime is this considered? Where is the information that I gave them going? And also, what is the payment process for these kinds of fines like?

    It would probably be misdemeanor shoplifting. The information you gave them goes 3 places:
    1. Their internal database to document the incident and identify you if you are caught again.
    2. The National Retail Theft Database, a repository for the information on adults caught stealing from retailers. It is often checked by prospective employers (definitely retailers and maybe others. Who exactly can access it is closely guarded info) to determine if you have ever been naughty.
    3. To the company that oversees their civil demand program to send you that fine they told you about.

    If they, at a later date prior to the expiration of the statute of limitations, decide to press charges it will also be sent to the police.

    How far under $100 were you? Anywhere near $100 used to be an automatic call to the police.

    The payment process will require you to pay the fine normally in a lump sum although you may be able to contact them (using the number that will be on the civil demand notice) to arrange a payment plan if a lump sum is not possible.

    I was around 25 dollars under 100 dollars. (I was considered an accomplice with my friend who also stole stuff, so really I just regard it as my fine, because we're both getting fined the same amount). Maybe we were a pity case? Who knows. I do know that I did learn my lesson.

    Now, what kind of class would this misdemeanor be considered?

    I apologize for double posting, but I do have a question: Do you know how long the average time is for someone to receive a civil demand letter?
