    Default Petition on Alien Relative Under F2a Permanent Resident Petitioning a Spouse

    I am a US permanent resident and is currently filling a petition for my husband but before I submit them I want to make sure that I'm doing it right and would appreciate your advise.

    1. As an initial step what are the forms that I should fill up for the petition for an alien relative?
    a. I 130
    b. G325A (Biographic Info) and
    c. G1145A (E notification)

    2. Can I fill up the form G325A without my hubby's signature? I want to submit them as fast as I can if signature is needed can I submit a scanned G325A form?

    3. I would also like to know what category do we belong are we under family based 2a? Permanent resident filing a petition to a spouse. Is it true that they are currently processing April 2010 under this category Family based 2a? Does this mean that we only have a few months to wait as compared to the waiting time before which is 5 yrs? If yes then this is great news.

    4. Is it true that if my husband's petition has been approved, he can not work in US until I become a US citizen?

    5. Hubby has a valid E2 visa till 2013 but currently is out of the country (not in US at present) can my petition affect his E2 visa. Been hearing some news that his E2 visa might be cancelled once USCIS learned that he has a pending petition. Is there some truth about this.

    Would appreciate your input regarding my query.

    Start by reading this.

    You can help your husband complete forms, but where he's instructed to sign the forms it should obviously be his signature.

    For current processing times, consult the Visa Bulletin.

    There's a limited form of dual intent for which people who hold E visas are eligible, under which the E visa holder establishes that he will not remain in the United States to adjust status to lawful permanent resident or otherwise remain in the United States regardless of the legality of his or her status. If your husband wants to maintain his E visa while you petition on his behalf, I suggest that he consult an immigration lawyer about the specifics of his situation. I suggest that, as well, if you plan on living apart.
