Okay I understand but my boss is going on what someone told him, he didnt even physically see the posting. Other than that like I said I never mentioned the company's name. Im pretty sure I can bitch about work to friends as they do to me in a facebook thread..it wasnt even an status update. I dont know , this to me all seems like an excuse to get rid of me since the company has been trying to offer buyouts and or just fire people.
You can complain all you want to, but words have consquences. Obviously somebody in your "private group" blabbed. You don't have to mention the company name. People who know you know where you work.
If they wanted an excuse to fire you, you just gave them one.
No screen shots...showed me a letter from somebody that was hand written to him. I came to find out it was a supervisor who doesnt even have facebook who just overheard people talking about certain things in the work place so basically , they dont have proof...its just hearsay...Not to mention this supervisor hates me. we've had history before he became a boss...which was like last month. He's out to make a name for himself , thats all it is. But as I said. They have no actual proof , it was just a letter written to them about what was said.
They don't NEED proof. Private employers don't have to have a trial, a hearing, or a grievance process before making employment decisions, unless there is some binding agreement that holds them to such a process - otherwise you're employed "at will" - meaning you're free to leave, or they're free to terminate you. They can fire you for ANY reason that isn't protected by law. The boss could have fired you for wearing a color of shirt he didn't like. They can even fire you based on gossip about what was on your Facebook page, whether it was actually there or not, or if they ever saw it or not. If they were annoyed hearing about it, and your name was connected to it, that's a reason (note that REASON is not the same as "for cause", which plays a part in determining unemployment benefits and has it's own process. Make sure you file for unemployment ASAP.). The only people they have to convince that it was a good ENOUGH reason is whoever above them in the chain of command might ask.
New York is an at-will employment state, meaning you can be fired for whatever reason the management dreams up regardless of its validity, or they can fire you for no reason at all. This applies unless you are under an employment contract. I doubt that the boss is calling you back because of feared legal issues, but rather for violation of company policy.
Anything that you post of any social networking site becomes public, and therefore you don't have any expectation of privacy. More and more companies are using what is posted online to disqualify, terminate, or discipline employees, so be careful what you post.
