    Default Withdrawal of an Assault Case

    My question involves criminal law for the state of: Michigan

    Hello guys,
    My roommate, who he is my cousin as well, assaulted me couple months ago. I called the police right away and now he got a court order for hearing (Assault/Battery). HE is in a big mess so I’m being pushed by other family members to withdraw/dismiss the case.

    I haven’t sued him; it's between him and the city where the accident happened. I'm just wondering if it's possible to withdraw the case, or make an arrangement outside the court. Personally, I don’t want to do that. I'm just looking for a legal excuse for the other family members.

    Your legal excuse is that it is no longer your decision. Once you make the report and charges are filed, it is entirely in the hands of the state. It is possible, though unlikely, that the prosecutor would not move forward if you requested it or refused to cooperate so it's out of your hands.
