    Question 16 Year Old Left Home and Wants to Live with Grandma

    My question involves juvenile law in the State of: Texas

    My 16 yo son left home last night and went to his grandma's house. He has a lot of issues we have spent a couple years dealing with in counseling (and the psych ward - and the hospitals frmo overdoses). He has decided he doesn't like our rules and wants to go somewhere he feels "accepted". He has said that we have been abusive to him and that his dad regular leaves him bruised and bloody. But that hasn't happened and there are plenty of witnesses to verify that. Anyway - we have gotten to the point that we are fed up w/ his manipulation and trickery to get what he wants. The lying, stealing, blatant disregard for the rules and everyone in the fmaily. (He has even said in counseling (family) that it doesn't matter who he hurts in our family as long as he gets what he wants).

    So if he wants to live w/ my mom - we are trying to decide if we are willing to let him. But we need to know the legal ramifications - what we need to do, who we need to talk to, and how to protect ourselves legally. Help!?

    Simply living with grandma with your permission doesn't change anything legally. You'd still be his legal guardians, he'd just be living under grandma's roof (or the roof of anyone else willing to allow him to co-habitate).

    If grandma or any other third party wants to become his legal guardian, they'll need to go through the process in the probate court for the county where the minor currently resides. Be aware, however, that such a request in this situation is going to be looked at closely by the court, and the court is only likely to consider such a change if it is convinced that somehow such a move is in the MINOR's best interest (in other words, if the change would provide better stability, more supervision, more frequent counseling, etc.).
