    Default Illegal Mexican - Any Positive Future

    Dear readers,

    I am in so much trouble. I'm in love with a Mexican who stays and works in the USA illegally. At least twice he crossed the border without any inspection, last time - 8 years ago. Birth Certificate is the only valid document he has. SSN, Arizona ID were bought. He has no driver license. He is currently employed and has been working for his company for more than 3 years. I guess he used his fake papers filling I-9 form. Moreover, I know that he was judged for stealing 11 years ago (paid the fee).

    He is a good person and for sure regrets about his past, but all I want to know - does he have any possibilities for future? What is the punishment for using fake papers? May he get legal papers one day? Some of his relatives (uncles, aunts) live in Arizona legally with permanent residence cards. Can it help somehow?

    If he's totally escaped the notice of the US officials, he might go back to Mexico and apply for a legitimate entry.

    However, the truth of the matter, is that he's here illegally and has been for an extended period and he legitimately would be deported and even if he left voluntarily will be subject to a 10 year bar on even attempting to get a legitimate entry. Relatives, or even marrying a US citizen will not improve his status.

    He has committed identity theft by using a SSN that could belong to someone else.

    Why would you want to be involved with someone who would knowingly create such problems for an innocent victim of his illegal actions?

    There is no forgiveness for using someone's SSN. As a possible mom of a victim I can't accept the fact.
    At the same time if I was a person who came to the US illegally, and had only two options: make my money committing crime or buy a fake document that gives me a right for employment, - I would also choose the second option.

    First of all, YOU are not in any trouble. His best bet is to apply for legal entry. If he is convicted of fraud or identity theft or anything of that nature, no immigration judge in his right mind is going to allow him to stay here, married to an American or not. When his past is discovered, he'll be convicted, when he's convicted, he'll be deported, and he will be banned for 10 years.
