My question involves criminal law for the state of: TEXAS
So here is the deal. I got a class 'B' missdemeanor back in 2001 for 'selling' alcohol to intoxicated person. According to this rule:
§ 101.63. SALE TO CERTAIN PERSONS. (a) A person commits
an offense if the person with criminal negligence sells an
alcoholic beverage to an habitual drunkard or an intoxicated or
insane person.
I never sold the beer to that person, i merely sacked it up, since my friend, the original seller, had to run to restroom. Now i got this missdemeanor sitting on my record, and will haunt me for the rest of my life. Whats the best possible way to get rid of this record. I am wililng to spend, whatever it takes to get it off my records and gone completely. Should i go ahead and file a lawsuit against TABC or shoudl i just appeal to reopen the case?
Any ideas will be appreciated.
