    Default Divorce While Living Abroad

    My question involves a marriage in the state of: Merida, Mexico

    I got married in July 2006 in Gaithersburg, MD. We both are mexicans. The relationship start getting bad, and me and my family was worried about my security, so I ran away on April 13, 2009. I didn't file for a separation, nothing, all I wanna do was ran away from him. He was getting more violent as time goes by. He never hit me, but things weren't ok. So I had to leave without him knowing. My family bought a ticket to go and get me and I came back to Mexico.
    Now almost 2 years after that I want to get a divorce. I send some papers to the court but they haven't send an answer. I need to know what can I do in order to get a divorce while I am here in Mexico, I do not longer have a visa to go back to the states and take care of everything...
    I want to get the divorce ASAP. What can I do?

    File in Mexico. You can't file in the US, you're not a resident here.

    Beyond that, we can't help you. You'll need to consult counsel in Mexico. We only handle US law here.

    But, if he is still there, I cannot file for the divorce? Hire a lawyer or something?

    If you aren't able to travel to the U.S. for required court hearings, that would become problematic.

    I know that I cannot go, due to not having a visa. The thing is, I didn't validate my marriage in Mexico trough the embassy, acording to my country I'm still single, I'm listed as a single person. And now I am in a new relationship and about to get married, he is from Europe but we cannot get married without the divorce papers. I really need to know what other options I have. I know that marriage is not valid for my country since I didn't go to the Mexican embassy in MD. So is just valid in the USA and I need to get the divorce. Do you have any suggestion? What else can I do? There has to be a way to get that. Is not annuled after 2 years of separation??

    No, marriages are not automatically annulled for any reason in the US; the court will always need to be involved and formal annulment, divorce or dissolution proceedings followed.
