    Angry Neighbor Trespass

    I'm not sure if anything can be done about this but I am desperate. The neighbor next to me has male cats that she keeps in cages outside, like dog kennels. The cages are covered and the cats kept on leashes. In the spring when the female cats are in heat she will take all the females she can find, breed them by forcing them into the cage and holding them there until they are done, and then she releases them into the yard. They then come into my yard and have their kittens on my property. Is there anyway I can make her get rid of her animals or stop this because I am the one being overrun by cats and having to take them to the Humane Society. I literally have stray cats all over my yard, and then the other day i caught her feeding the cats and taking them onto her property and putting them into a bed. Keep in mind that most of the female cats end up pregnant before they are a year old. Is there any law about trespassing or purposely putting the cats on my property as she informed me she does at the grocery store?

    Lots of times you need to look at local regulations and ordinances where animals are concerned and they vary greatly from city to city. Outside of that, what you have described would most likely be considered a common law nuisance. You would need to get an attorney and see if you could get an injunction against the woman. Before you do that you might want to call animal control--they know animal ordinances well as they have to enforce them. They will know whether there is any basis for them to take action and that might save you from having to go through the process of filing a suit yourself.

    I live in Michigan. I called animal control but they said that as long as she is feeding them there is nothing I can do. Last night though she stole the kittens and put them in her cages! So now she is going to get them pregnant as soon as she can. But she left the mom outside of the cage. The kittens need their mom to eat. Please help me.

    What do you mean "she stole the kittens" - didn't you say that they're her cats and kittens?

    Litigator is probably correct, that the best path may be to take her to court on a nuisance action and try to get a court order prohibiting her conduct. If she's selling the kittens, it may also violate local zoning ordinances relating to operating a business out of her residence - if that's the case, your local government may well try to put an end to her business, which would save you the expense of trying to shut her down yourself. Also, even if animal control isn't aware, its worth checking to see if your locality has an ordinance limiting the number of pets somebody may own.

    What i mean by she stole the kittens is that the cat that she intentionally got pregnant was a stray living on my property and she didn't want the kittens until she thought i was going to get rid of them. But i couldn't because the Humane Society was full and was just going to kill them. But now that the kittens are home she stole them off my property when Anima; Control said that if they were born on my property they were mine, also she told me they were my responsibility when i ran into her at the store.
