    Default I Am Transferring to a School in Another State and My Roommate Refuses to Release Me

    My question involves landlord-tenant law in the State of: North Carolina.

    So, my roommate won't let me leave. Although I did promise her to find someone, she always finds something wrong with that person. I have had several people that have wanted the apartment but she continues to turn them down. She acts very hostile around me, she avoids the subject and she is not making any effort whatsoever to find someone else. Also, she does not want to pay me for a washer and dryer we split but she wants to keep, or other appliances we split in half.
    I found her randomly and we have only lived together for 3 months. I need to know what steps I can take to be released from that lease. She has always tried to argue with me and I am afraid she will do something against me. Therefore, I had to put a key lock so I can lock my room. I am afraid she has bipolar disorder.

    Keep good records of your efforts to find a replacement roommate and her reasons (or lack thereof) for rejecting them such that, if you stop paying rent and she attempts to sue you, you can attempt to document to a court that she was unreasonable in her refusal to accept a replacement roommate.

    Note that if your lease requires your landlord to approve a substituted roommate, you should have your landlord approve the prospective roommates as well.

    Absent a provision to the contrary in your lease, your landlord is under no obligation to release you before the end of your lease. If you move out and your roommate fails to pay rent, your landlord can pursue you (along with her) for the unpaid rent.
