My question involves name change laws in the State of: Florida/Oklahoma
I have a 3 year old son. His father and I were not married when he was born and he his not on his birth certificate. He has never paid a dime of child support and hasn't been in my son's life since he was 10 months old. I have since gotten married and my son has no idea my husband isn't his biological father (he's been there since he was one) and I would like to keep it this way. There are a few problems though. One, he has his biological father's last name. I have no clue where this guy is. He has warrants in 3 different states and is constantly in and out of jail but doesn't stay long because he somehow comes up with bail money every time. I figure if the state can't find him for criminal issues, how will I find him for this, much less child support? He has a serious gambling problem, drug addiction and is a raging alcoholic and is being sued by hundreds of old business partners for stealing millions of dollars from people, not to mention I had to file domestic battery charges on him two times and had a restraining order put on him although no one could ever find him to serve him with it. (If you haven't figured it out yet, this guy's a real winner! Haha) Two, we had a paternity test done when my son was born. It wasn't court-ordered or anything, just done at a private DNA center. As far as I know, there is no record of this but I am wondering if this could cause an issue. And three, my husband is in the military. We are currently stationed in Oklahoma and have no intentions of traveling back to Florida (where my son was born) anytime soon. I was wondering if this could also be a potential issue. Any advice is GREATLY appreciated! I am so lost right now and have no idea where to even start at getting this resolved. Thanks!
