    Default Adding Father to Birth Certificate

    My question involves adoption law for the State of: South Carolina

    long story short i have a daughter 9 months old- her sperm donor is not listed on her BC he isnt in her life no one is listed as the father. can i list my soon to be husband on her BC as her father?

    No. That would be fraud.

    He will have to legally adopt her.

    Seriously - you and your soon-to-be husband are planning to sign a legal document, under penalty of perjury, testifying that he is the child's father.

    That's obviously not the truth....

    (Does the biological father know about the child?)

    ..and you chose that sorry piece of human flesh to father your child. You may well be stuck with him for the next 18 years or so.

    As bad as that sucks, it's the legal reality. As of right now, the child appears not to HAVE a legal father. You can either let it stay that way (until her father challenges it, if ever), or you can get married, and then your hubby can petition the court to adopt (which means the father would need to be identified and notified of the intended adoption and can then either contest it or bless it). But you getting married now doesn't automatically make your husband her legal father, and knowingly falsifying that document can result in criminal charges Even IF you choose to commit the fraud on the birth certificate, the father could STILL challenge paternity. The only way you'll be rid of him forever is by successfully completing the adoption process.
