    Default Was Caught Shoplifting at JCPenny

    sometime around mid sept.
    like an idiot i walked out with a pair of levi's jeans, a belt that i had put on in the dressing room, and a nike t-shirt that i had also put on and i just simply walked out;
    as i was walking out of the store i wasn't really trying to leave the mall, i know i had the biggest guilt look on my face and i looked retarded walking around with a pair of jeans that had the tags still on them, sure enough as i walk out past the metal detectors, maybe 15 feet from the store i see this guy from the corner of my eye grab my right arm and i immediatly knew what was up, then another guy grabbed my left arm and they both presented themselves as mall security and told me to go with them, so i cooperated i didn't refuse anything, one of them asked me why i did it and i just said 'because i have no money'

    so they took me into the elevator then proceeded to go to the basement that's where they sat me down inside this little room and before that they frisked me, made me take off the stolen goods and then they began putting papers in my face that i needed to fill out, i cooperated so i filled out whatever papers they wanted me to fill out, and it was just pretty much papers that state that i stole from their company and how it was causing them loss of money and how it happens more than you think.

    they fined me 94$ and banned me from the mall for a year, then they brought a police officer in and this guy was really laid back so were the two mall security officers, everything was going smoothly and whatnot, before the cop came the security officer told me that he was going to put in a good word for me since i was cooperative,
    long story short(lol) the cop came, had me fill out papers with my personal info,
    then they brought in another mall security officer who took a picture of me and the stolen goods, told me that i was banned and the cop escorted me out to the bus stop.


    anyway, i was just wondering since they told me i would receive a letter of some sort (which i have not received yet) i was just wondering what the letter would be and the cop told me i'll have to attend court to sort out if i'll be let go with a fine and probably a probation sentence or face 90days in jail, i'm not necessarily scared or frightened i'm just curious as to what could i be facing here ?

    i'm 18, and this is the first time i've ever been in this situation.

    i just need some closure from people who've been in my situation as to what will happen to me and my adolescent mistake.

    The letter will be a civil demand letter, sort of a civil penalty for your actions. These sometimes take a month or so to get to the person. Pay it.

    Legally, if it's your first offense you will probably get a slap on the wrist (fines, probation and maybe some community service). I say probably because each and every case is unique, it is impossible to be certain what you will get in punishment at your court appearance.

    alright, thanks for your response.

    my last two questions are;
    what are my chances of actually being sentenced to 90 days in jail ?
    & the two security officers told me that this was most likely not going to end up on my record, do i stick to their word or think otherwise ?

    Again, no one can be certain or can even guess at your odds of doing jail time. If I had to guess, I'd say no but don't take my word as gospel.

    You may be able to work a deal for some kind of deferred adjudication or other such method of having the charges dismissed if you are a good boy for so long or maybe plea to a more minor charge. A consultation with a criminal defense attorney will yield you better info than I can give since I'm not familiar with WA criminal courts. What criminal code section were you charged with violating? It should be on the citation the officer gave you.

    i see.

    well, i don't have money to hire an attorney rather less have money to pay the 94$ fine.
    i wasn't given a citation just a civil demand notice, i just looked at it and it does have a number at the top right numbered # 10-6529
    is that what you were asking for ?

    A consultation with a Criminal Defense Lawyer is usually free. Check the phone book, call around. Have your questions ready.

    You will have to pay that Civil Demand. Otherwise it gets more expensive, and then they can take you to court for it. And since you're 18, it will be a big blemish on your Credit Rating - in other words, when you can afford it - good luck getting a credit card or that first apartment.
