    Default Marrying My Girlfriend Who Has Used a Fake SSN and Has an Expired Visa

    Hello,
    I hope someone can help me here as Im worried about what may come in the future. My girlfriend and I plan on getting married soon, but there are two issues we are facing. She has an expired tourist visa, and over a year ago she used a fake ssn to get a job and do her taxes. Im aware of the penalties of this crime, but Im wondering since she no longer uses the ssn, is it possible that she wont be questioned about it when we go through the immigration interview? I understand the expired visa can be forgiven, I'm mostly worried about the ssn issue. I hope you can help me feel optimistic. Thanks

    You're wrong about the forgiveness. Things aren't what they used to be. She may be facing a three year bar on a simple overstay. Marrying you will not improve her situation. The SSN is a criminal problem, but working on a tourist visa (even one that's not expired) is a problem as well. Given her stay of over a year and illegal activity she is likely facing a ten year ban even if she voluntarily leaves before she is deported.

    If there's any chance of mitigating this you'll need to see a immigration lawyer asap.

    If she entered the country legally, then she should be able to adjust her status without leaving the country based on your marriage. I went through the same scenario (Fake SSN, working and overstay) with my wife starting 2005 and none of that caused any problems.

    Right. Although there's some risk during the period prior to adjustment of status, if you entered the country legally (for most visas), even after an overstay you can petition to adjust your status based upon marriage to a citizen. The fraudulent use of a Social Security Number could, but won't necessarily, create problems.

    You may want to discuss things with an immigration lawyer to make sure that your wife would be eligible to adjust her status based upon her visa (e.g., it was not a J1 visa with a two year home country residency requirement), and to review issues that may arise from the fake SSN.

    Unless, of course, the fake SSN was used to claim citizenship.
