My question involves a security deposit in the State of: PA
In December of 12/09, we moved out of a duplex rental. The place was unbearable to live in due to rotten water smell. Also, black soot in bathtub coming through drain. We lived there for approximately six weeks. We gave him 30 day notice. He verbally agreed to give our deposit back, but he did not have the money at the time. The other tenant had her rent money held and was taking him to court as well. So, he was not collecting any other rent at the time. He told us that he would refund our money when he had it.
I sent him a certified letter, in the summer of 2010. He never picked it up, and it was returned to me. I just put this matter on the back burner. However, I would like to pursue this again. I was wondering if the statute of limitations would be up, for we are hitting the year mark. If not, could we just file a claim at small claims court? I don't believe that he will pick up any certified mail.
