    Question Collecting Past Late Fees

    My question involves landlord-tenant law in the State of: California

    I have lived in my apartment for 3+ years, and over those 3 years, the landlord has had to remind me to pay rent 4 or 5 times because it was a couple days late. They never charged me a late fee because I was good tenant and it was always an honest mistake, never because I didn't have enough to pay the rent.

    So my question is: now that I am moving out, are they legally allowed to collect those past late fees if they originally waived them?

    Maybe.

    Should we infer that they're now trying to charge you the late fees? And that they're claiming that they didn't waive them, but simply deferred them as a favor to you?
