    Unhappy Vacating a Judgement Filed by Landlord, Without My Knowledge

    My question involves collection proceedings in the State of: TEXAS

    I was asked to vacate the property for non payment of rent; i did so, and 3-4 days later after i left, the landlord filed case against me for the unpaid rent. I was never served nor received any kind of notification from plaintiff or the court, that i have to appear before the court to prove my innocence.

    Court ended up putting this judgement on my credit and now i am stuck. How to get this judgement revoked/vacated or dismissed? I went to court to get more information but they flatly refused to provide any "LEGAL" advice. Can you please help me, what needs to be done about it?

    Did you give your landlord your new address? Did you even inform your landlord that you had vacated? If not, presumably you were served at the only address your landlord had for you - the rental unit. Check the court file and see.

    What's your defense to the judgment? You seem to be conceding that you didn't pay your rent.

    The defense is that i was never notified, either verbally or writtenly

    so, review the court record to determine how you were served. If that service is not legally acceptable, file to have the judgment vacated due to ineffective service of the complaint.

    Got it, i am in the process of getting certificates of service from court. Will post 'em here and maybe you guys can help me understand if it's legal or not Me a noobie .... !

    Ok, so i called the court and they told me that notice was posted on my door. Hell i left apartment like 4 days before the end of the month, and management knew that i was not living there anymore.
