    Default Changing Child Last Name on Birth Certificate - Father is Deceased

    My question involves name change laws in the State of: Mississippi

    I would like to change my daughter's last name to my maiden name. Her biological father's name is on the birth certificate. However, he is deceased. She does not have any contact with his family. She doesn't know them at all.
    She does not receive any benefits from him. They said he didn't have enough income credit. Is there anything I can do to receive assistance from social security for help with her?
    Please let me know what I need to do to get this done.

    You can file in court to change your daughter's last name; since Dad is deceased there will be nobody able to object.

    Call the local court-house and ask which form/s you need; the clerk can help you locate the forms although s/he can't help you fill them out.

    Unfortunately if she doesn't qualify for SS dependent benefits, there really isn't much you can do.
