    Default Pregnant Teen Fears for Baby if Forced to Return Home

    My question involves juvenile law in the State of: Michigan and Wisconsin

    my son, turned 18 today, and his girlfriend, 16, are having a baby, due in february, right after her 17th birthday, approx three weeks after. Her mother is in michigan and we are in wisconsin. Her mother gave her permission to move in with us several weeks ago. Now that she is settled, her mother is demanding she move back. She was pregnant once before and her mother coerced her into an abortion. She seriously fears for this baby's life. Can she be forced to move back?

    Absolutely.

    Until she is a legal adult, or until there is another legal guardian, her parents decide where she lives, and for how long. And, anyone interferring with that parental authority can get themselves in serious legal trouble, including the possibility of criminal charges, for interferring with that parental control, contributing to the delinquency of a minor, and harboring a runaway. Parents have the absolute legal ability to both give and to revoke such permissions. If she doesn't want an abortion, then she needs to simply tell mom "no" or tell the people at the clinic "no". Abortion clinic workers won't perform any procedure if they have reason to think the choice isn't 100% on the up and up with the mother.

    ok...let me add that she is into her second trimester and fears that they will physically harm her resulting in loss of the baby, not another abortion...she actually kept the pregnancy from them until her second trimester, which we also did not know until the same time period...what recourse does she have? Forget about us, but her...what are her rights? Doe she ahve the right to protecvt her unborn child?

    She has no recourse until and unless someone attempts violence against her. If that happens, she needs to be calling 911. Unless there is some history of parental violence against her, her fear alone isn't going to be a factor. If there are documented incidents, that's another matter. If she is attacked, she has every legal right to self defense.
