    Default Breaking Lease Options Before Move in

    My question involves landlord-tenant law in the State of: Pennsylvania.

    I recently signed a lease with a significant other. Since which time we have parted company. But still have a signed lease with an apartment for an October move in date.

    He will be staying at the apartment and "paying rent". I called the landlord today to ask about getting my name removed from the lease. I even told them I would be willing to my my half of the rent. Money is not the issue here. I am concerned that the screwball boyfriend will not pay the rent and or mess up the apartment which will leave me on the hook for damages and unpaid rent. Any advise?

    short of that, you don't really have any options. You have signed a contract and can be held to that contract.

    Since money isn't an object here, have you considered offering money to the LL and/or the other tenant in order for them to agree to terminated the lease?

    Offered money to the landlord. Still will hold me responsible for the apartment. Afraid of giving money directly to the "significant other" directly unless he signs a document.

    Can my name be possibly removed from the lease if other tenant agrees?

    PS. She is allowing us to break the lease with three months rent paid. That is what i am really trying to find out. If I pay her the three months rent (my half) and not live there at all, can I get my name off of this lease. My half of three months rent would be about $1300. The full amount is of course double that. Not sure if I am willing to write that big of check so quickly and just trying to see what options may be there.

    not unless the landlord also agrees.

    then there is your answer. That doesn't mean there would be 3 months paid on a new lease. This is merely being accepted as a termination fee. Unless the other tenant is simply willing to accept paying that to allow you off the lease, you may find yourself paying the full termination fee.
