    Question Criminal Trespass in Pennsylvania

    My question involves criminal law for the state of: PA

    Let me try to make this as short as possible: I got into some trouble when I was 18-20 years of age. I have a prior record score of 2. My prior charges where for theft and bad checks. I know, not the best, people make mistakes and I paid for my crimes. I am now being charged with criminal trespass (felony 2). I am trying to figure out the sentencing guide lines for PA. What level would i be?
    I do have a full time job and 2 kids. Wondering if jail is going to happen as well? I have a public defender and he told me he thinks I will get probation because I have a job and 2 kids. I went today for a pre sentence investigation and the probation office that was doing the report said I might go to jail! So just wondering what everyone else thought.

    Didn't your lawyer tell you not to discuss the charges with the PO?

    no he didn't. the probation department are the ones that due the pre sentence reports.

    Since the people doing the pre-sentencing reports deal with it on a daily basis, they are probably a reliable source of information. But if your PD does his job well, you may be the exception to what the PO people normally see happen.

    If this were your first offense, I'd agree with your PD about your job and kids getting you a pass. Since you have had previous criminal convictions, that may not help you. Why were you charged at the felony level on the CT? Was it because of your criminal history or your actions that caused the charge in the first place?

    I was charged with a felony because of my actions. Several people, including myself, entered an apartment with the intent of removing items. There was other charges too but they were dropped in the plea if I took Criminal Trespass. My sentencing is an open sentence with no plea agreement for the sentence.

    I have never been charged with a felony. All my other chargers were from 7 years ago and they are M3's.

    Sentece wise no felonies and that it was 7 years can help you but the priors and since you stole can work aganist you. It's a toss up both the probation and pd are realablie source,I would agree with the Pd more . Did any of the other people get senteced yet,I head about cases where it went both ways,don't be shocked if you are senteced to a short amount of time in county or something,next time in trouble could be a decent amount of time.
