    Default Fare Evasion Ticket with Trespass

    Hi, Yesterday i got Fare evasion ticket in New York. Cop gave me another ticket with trespass. Actually i have unlimited path train pass but by mistake it did not swipe and i just passed. I am new here. How should i know what amount i need to pay? and how to pay? Ticket has summoned in NY court on 1 st December. If i will pay demanded amount will it affect my records?? Please help. Can i pay the amount asap? how to pay?

    How did you get through the gate if your pass didn't work?

    Presumably your ticket requires you to appear in court? That would mean you have to appear in court and cannot simply pay the ticket. I can't read it from here, so I have to rely upon you to tell us what it says.

    I got the same ticket along w. a friend,my friend showed his metro card and receipt,then they dismissed it. It's a violation and not a criminal charge,chances are if it's your 1st offense they may offer an acd sometimes,which dismiss the charge in 6 months if u stay out of trouble. An acd might be offered on one or both of the charges. For those 2 summons, it's required to show up in court. It's good to get there a little early. If u are found guilty they will tell you how much to pay. For the trespassing one it's required to show. I think each ticket is probably 50-100 each.

    Thanks for the reply. As Mr Knowitall said, my ticket require me to appear in NYC court. I am very confused what to do now? how if i simply appear to court and plead guilty. Will it be in my permanent record? is it big problem? anyway i am thinking to consult with attorney but just looking for suggestions from you. Please advice me. I am on H1B visa so how much this will affect on my history.

    i also got the same tickets 2 days ago... I am also confused what to do.. did you decide or did you find any desi attorny for you?

    I would see if an immigration lawyer or some immigration hot-line can answer your question about how it would affect your status. Just to be on the safe side. These 2 tickets are not that serious. I doubt it will have any effect on u,then again i'm not an attorney. Sometimes a lawyer can offer a free consultation. These are two minor charges,chances are the fine may be 100 dollars or just get thrown out.

    It a separate court from the criminal court,it's in a different section. I'm not a lawyer it may help to discuss the issue w. them. I doubt it would be much of an issue b.c it's not a criminal charge and u have a good shot at getting one of them dismissed. I don't think a conviction for a volition will affect your immigration status,it might not even be reported. It's a little worse then getting a traffic ticket or a jay walking ticket.

    The two question I would find out is if the cop just handed u a summons is it still considered an arrest. Just for any paper work you have to fill out for a visa or green card,etc. If you plead guilty then you have not been convicted of crime or have a criminal record. On a job application for example it ask have you been convicted of a crime,then u may answer no. Sometimes a job application or government paper will ask about being arrested. It seem like u weren't fingerprinted or anything the federal government or what ever immigration agency might not even found out about any of this.

    In the state of NY crimes/offenses are classified like this.
    Felonies,misdemeanors = criminal charges/convictions if found guilty
    violations-non criminal offense
    traffic tickets and stuff,what you charged w. is like a traffic but a little worse.

    thanks tc498.... the problem point is I am new here (in US) and leaving with my family that's why I am affraid to go court and etc.. God knows what will happend with us....
    I am not criminal and not good familiar with any court here...
