    Default Aggravated Assault

    My question involves criminal law for the state of: Georgia. I am currently in the Delayed Entry Program for the United States Marine Corps and I am suppose to go to basic training December, 6, 2010. Back in may I was drinking at a friends house and her roommate got in a fight with another male that was present. I tried to break the fight up and the guy attacked me, I eventually got away from him and he started choking the other guy, so I picked up a broom and hit him in the head to free him of the other person and I am now being charged with Aggravated Assault. Can I use first offenders in GA for this type of crime? If I do serve jail time what is the normal punishment for Aggravated Assault. Will it make a difference to the prosecutors that I am suppose to be going to recruit training in 2 months? So far I have not been given a court date and I am worried that I will get dropped from marine corps DEP. Also this is my first time ever being in trouble with the law.

    What exactly is the code under which you have been charged?

    code? as in use of a deadly weapon? Is that what you mean? belive that is it, but I'm not quite sure.

    No, I mean the exact code - statute - under which you're charged.

    Such as:

    Title 16, Section 16-5-21 of the Georgia criminal code (for example)

    (Looking at that section incidentally, you'll see that there's a sentence of not less than 1 year incarceration....and up to 20)
