Default "Account Closed" on Credit Report - What Can I Do

My question involves collection proceedings in the State of: Pennsylvania

    Summary:

Just checked my credit score and it has a negative status on it in the form of "closed account" from a electric company back from 2008. The apartment complex that i lived at set up the account under my name and my roommates name for us (bill came with our monthly rent). Half way through the lease i removed my name from the lease and had to pay the fees to do so in order to remove any responsibilities from it (have proof from the apartment complex showing this). This happened 01/2009 but the collection company showed that I owed the bill from 03/2009-06/2009 of service AFTER my name was removed (until 06/2009) and after contacting the person i was living with they had actually moved out from there before those dates (03/09-06/09). Since i removed my name off the lease no one informed me that i needed to contact the electric company to remove my name off of the account, not even sure if that would have been possible. I had not received any correspondence from the debt collection company nor the electric company until two months ago. Once i called them they said they would call the apartment complex and get back to me with thier findings, i did not receive any phone calls until i find out that they put it as "KD" on my credit, dropping it over 100 points.

But the account is only showing closed on my credit report and not theirs. Can this be disputed and taken of my credit report? Should i file the dispute asap? or try to contact the collections company and have them remove/delete the "Closed" account from my credit?

    Regards

I would look into who opened a account in your name if it wasnt you? there has to be a signature opening the account right? if the Electric company opened the account without verifing your identity you might have them. I dont think disputing it thru our credit reporting company will work untill you straighten it out with the electric company.

Thank you for replying, i will call on Monday and see whos name it was under when i left and why that person was not persued. The dates do not match up with what the collection company states they say its between times when no one even lived in the apartment. So i guess we will figure it out, meanwhile the KD still sits on my credit....

Called the collections agency, they are stating that there is nothing they can do about the KD on my credit. They stated it is actually against the fair credit reporting act to remove marks on reports. They are stating that they have been trying to call this whole time (have no received 1 call and i have my bills from my phone showing no calls ever received) they have also stated that they have limited info on which dates the debt is actually from. The initial call i made the rep told me that the bill was from dates that i wasn't even living there.

Now they have "closed" the account (shows a tradeline showing closed on the report i'm looking at) and are still saying they cannot even try to reverse any kind of marks on my credit. I have paid every single bill that i have on time since i was 18. Every credit card or loan i have is paid on or before thier due dates and my K/D ratio is well above the nation average. This is the first time this has happened on my report but obviously not one is taking that into consideration and my credit score has taken a 100 point hit for it...

You may have had a duty to inform the power company directly.

(That has been the case in every apartment complex in which I've ever lived - it was always the tenant's responsibility to ensure that their name was removed from the bill/service).

It seems that in your case, OP, nobody informed the power company and it stayed under your name until new tenant moved in.

what Im getting at is DID YOU authorize the bill to be opened into your name and give teh power company all your information or even authorize anyone else to? did you open up a account with power company? If you did then it was your responsibilty to make sure it was closed.

This is standard procedure in many apartment complexes.

Thank you for replying again guys!

It was the apartment complex that set it up in MY name and just my name and not my roommate. Even though they were named on the lease at the apartment complex. The circumstances here was that i left mid lease (removed my name off of the lease, mid lease). I was never told to cancel the electric as the apartment complex told me that electric was set up in the names of who ever was on the lease. I have since been in 3-4 conversations with the collections company. I am not refusing to pay but i want the KD removed from my credit and that trade line deleted.

Back tracking to my first conversation with the collections company the agent told me false information about the debt and of course told me dates that i would not have even been there. If they told me the right info then i would have known that some way i was responsible for this.

They have also refused to send any validation of the debt and showing that it is in fact me that owes the debt.

They have been saying the same thing over and over until now where i requested to speak with a person higher then a supervisor and but they have yet to return my call.

I have since pulled my credit reports from all 3 agencies and all but 1 show the account CLOSED out and noted "FAILED TO PAY". The collection company begs to differ, they stated they have not reported the account as closed.

I am not refusing to pay this at this point, i am willing to dish out the $191 but i want at least some sort of validation on my report saying that this was resolved and reversed. They keep saying that they will put a paid in full note on my report as a courtesy for paying this......but don't they need to send that out anyways? Wouldn't it be illegal if they still tried to pursue the debt even after it was paid?

Also they keep saying that after i pay this i can dispute it with the credit bureaus...but that's only for disputing FALSE information, not just frivolous reasons which this maybe considered.
