    Default Public Drunkenness

    My question involves criminal law for the state of: Pennsylvania

    Last week sometime we were out at a casino having a few drinks. When we left we stopped at a gas station to get something to drink. Someone started saying something to random people there so I started walking because I didn't want any trouble.

    About five minutes after the people I was with came to get me. They had to pull into a parking lot of a car dealership to wait for me to get there since I was on the opposite side of the road. I guess this was suspicious with the police officer driving by. He talked to us for a few minutes and we were on our way.

    I got home from work today and I have a $447.00 citation in the mail and a summons to court for public drunkenness. I don't understand why. Nothing happened and he didn't test any of us for alcohol.

    Glassy eyes, slurred or slow speech, dumb behavior (like pestering random passer-by) and the smell of alcohol emanating from you is sufficient.

    (Yes, people smell of booze when they drink. Even when it's only 1 or 2 drinks. As your body metabolizes the alcohol, your pores excrete really boozy smelling sweat.)

    I thought public drunkenness was something they arrested you for because you were doing something wrong while under the influence. Not let you go on your marry way then send you a surprising citation in the mail.
