    Default Odd Landlord Harrassment Issue

    My question involves landlord-tenant law in the State of: Virginia

    Three months into a six month lease I've had to leave and move in with a relative some distance away due to major issues of safety and health relating to a violent tenant. To give one example, this man tore a door from its hinges and destroyed the entire door frame in a drunken rage late one night. I assume I'll have to take my landlord to small claims court for a breach of quiet enjoyment since she ignores my requests either to return my rental payment for this month or perhaps credit it to a future month after this is resolved. But this is the reason I'm posting a question. My landlord has shown herself to be completely ignorant of the eviction process and as a result is constantly calling me and asking for my assistance. I have told her I don't have the time or knowledge to get involved and that as the landlord it is solely her responsibility. Yet she will not stop calling me about this. Since the beginning of the month I've received calls at all hours of the day and night asking me to take her to the sheriff's office, the magistrate, the police station, etc. She is afraid to confront the man so she asks me to go by and check on things. The other day she called at 4:30 AM with some new trouble the man had caused. There is an elderly family member at my temporary residence and I have told my landlord her repeated calls are causing a disturbance. Asking nicely or firmly is to no avail. Any suggestions are appreciated, thank you.

    Generally speaking, having a problem neighbor in a different unit will not provide you with grounds to get out of your lease. This guy damaged his own door? That doesn't affect your unit.

    It sounds like you're moving anyway and want to use this as an excuse to get out of your lease. Don't count on it working, particularly given that the landlord appears to be responding to your concerns by evicting the person.
