My question involves estate proceedings in the state of: California
My widowed father died intestate. There are four survivng siblings. One sibling refuses to work out any distribution agreement on the estate property. The estate is has real and personal property. She wants certain real property conveyed to her, but does not want another sibling to have a specific piece of property conveyed. As executor, I have tried to negotiate so that all siblings have 1/4 the estate regardless of what maybe or may not be conveyed. No matter what I have proposed to finalize the distribution, it does not seem to satisfy my sister. The liquid assets have been nearly spent mantaining the estate for the 2 years this has dragged on, and at this point I am faced with taxes due shortly and little cash from the estate. I need to finalize or sell some real property. Since my sister now refuses to talk or do anything regarding the probate, should we just proceed with a fair distribution plan without her consent and let her dispute the proposed distribution in probate court? This issue has unfortunately turned most of the family against each her.
